In 2022, the National Board of Appeals settled a total of 9,885 complaints around workers' compensation, of which 29 percent of the cases have been overturned. This is an increase in the conversion rate of three percentage points compared to 2021 but at the same level as in 2020.
The Danish Appeals Board has published its annual report on the handling of complaints from Labour Market Insurance, and in 2022 the report contains new, more in-depth figures on the outcome of the complaints. In the autumn of 2021, the Agency introduced new extended registrations on both AE's and its own result in the appeal cases.
These data have been applied for the first time in the new report, and show, among other things, that in cases of permanent disability in 2022, there is an almost equal distribution of changes in the upward and downward direction, and changes in the degree of disability are mostly in the range of 4-5 percentage points.
As a key figure, the report shows that last year the National Board of Appeals decided a total of 9,885 complaints around workers' compensation, of which 29 percent of the cases have been overturned. This is an increase in the conversion rate of three percentage points compared to 2021 but at the same level as 2020.
According to the agency, the increase in the conversion rate from 2021 to 2022 is due to an increasing share of complaints that have been changed. The share of cases referred, and cases suspended in 2022 is the same as in 2021. The conversion rate is highest in cases of permanent disability and lowest in cases concerning the recognition of occupational diseases.
The report also contains figures and trends on the reasons why cases are reversed – and a number of examples of specific cases have been selected to illustrate the trends.
- In cases concerning the recognition of occupational diseases, the recognition of accidents and decisions on permanent injury, the most frequent reason for changes is a different medical assessment.
- Changes to decisions on loss of earning capacity are most often due to a different discretionary assessment.
- In all the major cases, insufficient information is the most frequent reason for referrals.
